1. About Tandara
Tandara is a fashion and culture platform designed to help people discover, connect with and engage with the people, businesses, ideas and communities shaping African fashion.
The Platform may include editorial stories and journals, podcasts and other media, creator and business profiles, community discussions, user-generated content, creator applications and submissions, collaboration opportunities, discovery tools, marketplace features and other services introduced by Tandara from time to time.
2. Your Tandara Account
Certain features require an account. You agree to provide accurate information and are responsible for keeping your login information secure and notifying Tandara if you believe your account has been compromised. You must not create an account using another person's identity without authorisation.
3. Community and User Content
Users may submit comments, posts, photographs, videos, applications, creator information and other material ("User Content"). You remain responsible for your User Content.
You must not submit unlawful, fraudulent, defamatory, abusive, privacy-infringing, malicious, harassing or infringing content. Tandara may remove, restrict or moderate User Content where reasonably necessary to enforce these Terms, applicable law or community safety.
4. Your Rights in Your Content
You retain ownership of original content you submit. By submitting User Content, you grant Tandara a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, distribute, communicate, format, adapt and otherwise use that content as reasonably necessary to operate, promote and improve Tandara. This licence does not transfer ownership of your work to Tandara.
You represent that you have the necessary rights and permissions to grant this licence.
5. Editorial Content
Tandara may publish articles, interviews, photographs, podcasts, videos and other editorial material for information, cultural discussion, entertainment and educational purposes. Opinions expressed by contributors, creators, interviewees or guests do not necessarily represent Tandara. We make reasonable efforts to maintain accurate content but do not guarantee that every item will always be complete, current or error-free.
6. Tandara as a Marketplace Intermediary
Tandara may provide a marketplace through which users can discover, communicate with or transact with independent designers, creators, businesses and other users.
Unless expressly stated otherwise, Tandara is an intermediary/platform and is not the manufacturer, owner, seller or supplier of products or services offered by independent marketplace participants.
The relevant seller or service provider remains responsible for its products or services, descriptions and applicable transaction obligations. Tandara may facilitate discovery, communication, payment or other aspects of a transaction where applicable. Additional Marketplace Terms may apply.
Nothing in these Terms removes or limits consumer rights that cannot lawfully be excluded under Nigerian law.
7. Marketplace Transactions
When the marketplace becomes operational, additional terms may govern purchases, commissions, payments, delivery, cancellations, refunds, returns, disputes, seller obligations, prohibited products, reviews and ratings, and marketplace fees. These may be contained in separate Tandara Marketplace Terms and/or Creator/Seller Terms.
8. Payments
Where Tandara facilitates payments, payments may be processed through third-party payment providers and may be subject to their terms and privacy policies. Tandara does not intend to store complete payment-card information where it can instead be processed securely by an appropriate payment provider.
9. Creator Applications and Submissions
Tandara may invite applications to become creators, sellers, contributors, businesses or other participants. Submission does not guarantee approval. Tandara may assess applications for authenticity, suitability, quality, safety, relevance and compliance with Platform policies.
10. Intellectual Property
The Tandara name, logo, visual identity, website design, software, editorial content and other materials created or licensed by Tandara are protected by applicable intellectual-property laws. Except as permitted by law or with permission, you must not reproduce, modify, distribute, sell or commercially exploit Tandara-owned content.
11. Third-Party Services
Tandara may integrate or link to payment providers, social platforms, podcast platforms, analytics providers, cloud services and other third parties. Those services operate independently and may have their own terms and privacy policies.
12. Privacy
Our collection and use of personal information is governed by the Tandara Privacy Policy.
13. Platform Availability
We will make reasonable efforts to maintain the Platform but do not guarantee uninterrupted or error-free availability. Features may be temporarily suspended for maintenance, security, upgrades or other legitimate reasons.
14. Account Suspension and Termination
We may suspend or terminate an account where reasonably necessary because of violations of these Terms, fraud, security or safety risks, unlawful use, or protection of Tandara or its community. Where appropriate, we will provide notice and an opportunity to address the issue.
15. Disclaimers and Liability
Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited under Nigerian law. Tandara is not responsible for independent users' products, services, representations or conduct except as required by law or expressly assumed by Tandara. Any limitation of liability must be interpreted consistently with Nigerian consumer-protection law.
16. Changes to These Terms
We may update these Terms as Tandara develops. Where changes are material, we will take reasonable steps to notify affected users. Continued use after an effective update constitutes acceptance where legally permissible.
17. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Subject to mandatory consumer rights and applicable dispute-resolution requirements, disputes shall be subject to the jurisdiction of the appropriate courts in Nigeria.
